1. Introduction

Welcome to AgentixList ("AgentixList," "we," "us," or "our"). AgentixList is a mobile marketplace application available on iOS and Android, operated by Scibotix Solutions. Our platform allows users to buy and sell items locally, create and customize virtual stores, communicate with other users, leave reviews and ratings, and discover nearby listings and stores based on location.

This Privacy Policy explains what information we collect, how we use and share it, and what choices you have regarding your data when you use the AgentixList mobile application and any related services (collectively, the "Service").

By accessing or using the Service, you agree to the collection, use, and sharing of your information as described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Service.

This Privacy Policy is provided for informational purposes and does not constitute legal advice. If you have specific legal questions about your data or privacy rights, we encourage you to consult a qualified attorney.

2. Information We Collect

We collect information in three ways: information you provide to us directly, information collected automatically when you use the Service, and information we may receive from third parties.

2a. Information You Provide

When you create an account, use features of the Service, or communicate with us, you may provide the following information:

• Account Information: Name, email address, phone number, username, display name, and password.
• Profile Information: Avatar or profile photo, bio or description, and city, state, and ZIP code.
• Listing Content: Photos, descriptions, prices, and categories associated with items you list for sale.
• Store Content: Store name, logo, description, theme colors, fonts, operating hours, and cover images for virtual stores you create and customize.
• Communications: Messages you send to and receive from other users through the in-app messaging feature.
• Reviews and Ratings: Reviews, ratings, and feedback you leave for other users, listings, or stores.
• Support Communications: Information you provide when contacting us for customer support, including the content of your messages and any attachments.

2b. Information Collected Automatically

When you access or use the Service, we automatically collect certain information, including:

• Device Information: Device model, operating system and version, app version, and unique device identifiers.
• IP Address: Your Internet Protocol (IP) address, which may be used to infer your approximate geographic location (city and region level).
• Push Notification Tokens: Device tokens used to deliver push notifications through the Expo push notification service.
• Usage Data: Information about how you interact with the Service, including features used, screens viewed, actions taken, timestamps, and session duration.
• Approximate Location from IP: We may infer your general geographic area (such as city or region) from your IP address to help display relevant nearby listings and stores.

2c. Information from Third Parties

• Authentication Providers: If we introduce social login options in the future (such as Sign in with Apple or Google), we may receive basic profile information from those authentication providers, such as your name, email address, and profile picture. We will update this Privacy Policy before implementing any such feature.

We do not currently receive personal information about you from third-party sources.

3. How We Use Your Information

We use the information we collect for the following purposes:

• Operate and Maintain the Platform: To provide, maintain, and improve the core functionality of AgentixList, including account creation, authentication, and platform stability.
• Display Content to Other Users: To display your listings, store pages, profile information, and reviews to other users of the Service so the marketplace can function.
• Enable Communication: To facilitate messaging between buyers and sellers through the in-app messaging feature.
• Location-Based Features: To show you nearby listings and stores based on the city, state, and ZIP code you provide, or based on approximate location inferred from your IP address.
• Push Notifications: To send you push notifications about transaction updates, new messages, and other relevant activity on the platform.
• Safety and Security: To detect, investigate, and prevent fraud, unauthorized access, and other illegal or harmful activities, and to enforce our Terms of Service.
• Platform Improvement: To analyze usage patterns and trends in order to improve existing features, develop new features, and enhance the overall user experience.
• Customer Support: To respond to your inquiries, troubleshoot problems, and provide customer support.
• Legal Compliance: To comply with applicable laws, regulations, legal processes, or enforceable governmental requests.

4. How We Share Your Information

We share your information only in the following circumstances:

With Other Users

AgentixList is a public marketplace. When you create a listing, store, profile, or leave a review, that content is visible to other users of the Service. This includes your display name, avatar, profile information, listing details, store content, and reviews and ratings. Messages between users are visible only to the participants of that conversation.

With Service Providers

We use trusted third-party service providers to operate the Service. These providers only have access to your information as necessary to perform services on our behalf and are contractually obligated to protect your data:

• Supabase: We use Supabase for our database, user authentication, and file storage (such as photos and images you upload). Your account data, listing content, store content, messages, and other platform data are stored on Supabase infrastructure.
• Expo: We use the Expo push notification service to deliver push notifications to your device. Expo receives your device push notification token to facilitate delivery.

With Law Enforcement or Government Authorities

We may disclose your information to law enforcement agencies, government authorities, or other third parties if we are required to do so by law or if we believe in good faith that such disclosure is necessary to:

• Comply with a valid legal process, including subpoenas, court orders, or search warrants.
• Protect the rights, property, or safety of AgentixList, our users, or the public.
• Detect, prevent, or address fraud, security issues, or technical problems.

In Connection with Business Transfers

If Scibotix Solutions or AgentixList is involved in a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of its assets, your information may be transferred as part of that transaction. We will notify you via email or a prominent notice in the app before your information becomes subject to a different privacy policy.

What We Do NOT Do

• We do NOT sell your personal information. We have never sold personal information and have no plans to do so.
• We do NOT share your data with third parties for advertising purposes. AgentixList does not run ads, and we do not provide your information to advertisers or ad networks.

5. Data Retention

We retain your information as follows:

• Active Accounts: We retain your personal information for as long as your account remains active and as needed to provide you with the Service.
• After Account Deletion: When you delete your account, we will remove or de-identify your personal data within 30 to 90 days from the date of your deletion request. During this period, your data will no longer be visible to other users.
• Legal and Compliance Retention: Some information may be retained for a longer period where necessary to comply with legal obligations, resolve disputes, enforce our agreements, or meet tax and accounting requirements.
• Backup and Disaster Recovery: Copies of your data may persist in backup systems for a brief period after deletion as part of our standard disaster recovery processes. These backups are encrypted and are purged in accordance with our regular backup rotation schedule.
• Anonymized and Aggregated Data: We may retain anonymized or aggregated data that can no longer be used to identify you indefinitely. This data is used solely for analytical and statistical purposes, such as understanding platform usage trends.

6. Your Rights and Choices

You have the following rights regarding your personal information:

• Right to Access: You have the right to request a copy of the personal information we hold about you.
• Right to Correction: You have the right to request that we correct any inaccurate or incomplete personal information we hold about you. You can also update most of your profile information directly within the app.
• Right to Deletion: You have the right to request that we delete your account and associated personal data. Upon receiving a verified deletion request, we will delete your data in accordance with Section 5 (Data Retention).
• Right to Know: You have the right to know what categories of personal information we collect, the purposes for which it is used, and the categories of third parties with whom it is shared.
• Right to Opt Out of Sale: Although we do not sell your personal information, you have the right to direct us not to sell your personal information. This right is provided for compliance with the California Consumer Privacy Act (CCPA).
• Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights. We will not deny you the Service, charge you different prices, or provide you a different level of quality for exercising your rights.

When submitting a request, please provide enough information for us to verify your identity and locate your account. We may need to verify your identity before processing your request to protect your privacy and security. We will respond to verified requests within the timeframes required by applicable law.

Push Notification Preferences

You can opt out of receiving push notifications at any time by adjusting your notification settings within your device's operating system settings (iOS Settings or Android Settings). Please note that opting out of push notifications may affect your ability to receive timely updates about messages and transactions.

Location Permissions

You can control whether the app has access to your device's precise location by adjusting your location permissions in your device's operating system settings. Revoking location permissions may limit certain location-based features, such as discovering nearby listings and stores. The city, state, and ZIP code you provided during registration will still be used for general location-based features unless you update or remove that information from your profile.

7. California Privacy Rights (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), provides you with additional rights regarding your personal information.

Your California Rights

• Right to Know: You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which we collected it, the business purpose for collecting it, and the categories of third parties with whom we shared it.
• Right to Delete: You have the right to request that we delete personal information we have collected from you, subject to certain exceptions.
• Right to Correct: You have the right to request that we correct inaccurate personal information we maintain about you.
• Right to Opt Out of Sale or Sharing: You have the right to opt out of the sale of your personal information and the sharing of your personal information for cross-context behavioral advertising.

Our Practices Under the CCPA/CPRA

• We do not sell personal information. We have not sold personal information in the preceding 12 months and do not have plans to do so.
• We do not share personal information for cross-context behavioral advertising. We do not engage in cross-context behavioral advertising, and we do not share your personal information with third parties for such purposes.

We will verify your identity before processing your request. We will respond to verified requests within 45 days of receipt. If we need additional time, we will notify you of the extension and the reason for it. In no event will the total response time exceed 90 days.

You may also designate an authorized agent to make requests on your behalf. If you use an authorized agent, we may require you to verify your identity directly with us and confirm that you authorized the agent to act on your behalf.

8. Children's Privacy

AgentixList is intended solely for users who are 18 years of age or older. We do not knowingly collect, use, or disclose personal information from anyone under the age of 18.

We do not direct the Service to individuals under 18, and our Terms of Service require that all users be at least 18 years old. If we become aware that we have inadvertently collected personal information from a user under the age of 18, we will take prompt steps to:

• Terminate the user's account.
• Delete all personal information associated with that account as quickly as practicable.

We take reports of underage usage seriously and will investigate and act on them promptly.

9. Location Data

Location data plays an important role in how AgentixList connects buyers and sellers in their local area. Here is how we handle location information:

• User-Provided Location: During registration and in your profile settings, you may provide your city, state, and ZIP code. This information is used to display relevant nearby listings and stores to you and to show your general location to other users.
• Approximate Location from IP Address: We may infer your approximate geographic location (such as city or region) from your IP address. This is used to enhance the relevance of search results and nearby content when you have not provided location information or to supplement the location data you have provided.
• Precise GPS Location: If you grant the app permission to access your device's precise GPS location, we may use it to provide more accurate location-based features, such as showing listings and stores closest to your current position. Precise GPS location is only accessed with your explicit consent.
• Your Control Over Location Data: You can revoke the app's access to your device's precise location at any time through your device's operating system settings (iOS Settings > Privacy > Location Services, or Android Settings > Location). You can also update or remove your city, state, and ZIP code from your profile at any time within the app.

We do not continuously track your location in the background. Location data is accessed only when needed to provide location-based features within the app.

10. Data Security

We take the security of your personal information seriously and implement appropriate technical and organizational measures to protect it, including:

• Encryption in Transit: All data transmitted between your device and our servers is encrypted using Transport Layer Security (TLS/HTTPS).
• Secure Authentication: User authentication is managed through Supabase, which provides industry-standard authentication mechanisms, including secure password hashing and session management.
• Row-Level Security: Our database employs row-level security (RLS) policies to ensure that users can only access data they are authorized to view, preventing unauthorized access at the database level.
• Access Controls: Access to user data within our organization is restricted to authorized personnel who need it to operate and maintain the Service.

However, no method of electronic transmission or storage is 100% secure. While we strive to use commercially reasonable means to protect your personal information, we cannot guarantee its absolute security. Unauthorized access, hardware or software failure, and other factors may compromise the security of user information at any time.

We encourage you to take steps to protect your account, including:

• Using a strong, unique password for your AgentixList account.
• Not sharing your login credentials with others.
• Logging out of your account when using shared devices.
• Keeping your device's operating system and the AgentixList app up to date.

11. Third-Party Links

The Service may contain links to third-party websites, applications, or services that are not owned or controlled by AgentixList. This includes, but is not limited to, links that users may include in their listings, store descriptions, or messages.

We are not responsible for the privacy practices or the content of any third-party websites or services. This Privacy Policy applies solely to information collected through the AgentixList Service. We encourage you to review the privacy policies of any third-party websites or services you visit before providing them with any personal information.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make changes to this Privacy Policy:

• We will update the "Last Updated" date at the top of this document.
• For material changes that significantly affect how we collect, use, or share your personal information, we will provide notice through the app (such as an in-app notification or banner) or via email to the address associated with your account.
• If required by applicable law, we will obtain your consent before making material changes to how your data is processed.

Your continued use of the Service after any changes to this Privacy Policy constitutes your acceptance of the updated policy. If you do not agree with the updated Privacy Policy, you should discontinue use of the Service and delete your account.
